Welcome to SpicySnaps. By accessing or using our website, mobile applications, or any of our services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.

These Terms constitute a legally binding agreement between you and SpicySnaps ("we," "us," or "our"). We may update these Terms from time to time, and your continued use of the Services after such changes constitutes your acceptance of the updated Terms.

2. Age Requirement

You must be at least 18 years of age to use SpicySnaps. By creating an account or using our Services, you represent and warrant that:

• You are at least 18 years old
• You have the legal capacity to enter into binding contracts
• You are not prohibited by law from using our Services
• You will not allow anyone under 18 to access your account

We reserve the right to request proof of age at any time and to suspend or terminate accounts that we believe belong to users under 18.

3. Account Registration

To access certain features of our Services, you must create an account. When registering, you agree to:

5. Ordering & Payment Terms

5.1 Placing Orders

When you place an order through SpicySnaps, you are making an offer to purchase products. We reserve the right to accept or decline your order for any reason, including but not limited to product availability, pricing errors, or suspected fraud.

5.2 Pricing

All prices are displayed in USD unless otherwise indicated. Prices include the base product cost and any creator markup, but do not include shipping and applicable taxes, which are calculated at checkout.

5.3 Payment Processing

Payments are processed securely through Stripe. By submitting payment information, you authorize us to charge your payment method for the total order amount. We do not store your full credit card details on our servers.

6. Shipping & Delivery

All products are printed on demand by our fulfillment partner, Peecho. Please note:

• Production typically takes 3-7 business days
• Shipping times vary based on destination and shipping method selected
• All shipments are packaged discreetly with no indication of contents
• You are responsible for providing accurate shipping information
• International orders may be subject to customs duties and import taxes

We are not responsible for delays caused by carriers, customs, or incorrect shipping information provided by you.

7. Returns & Refunds

Because all products are custom-made to order, we generally cannot accept returns for buyer's remorse. However, we stand behind the quality of our products:

• Defective Products: If your product arrives damaged or defective, contact us within 14 days for a replacement or refund
• Wrong Item: If you receive the wrong product, we will send the correct item at no additional cost
• Lost Shipments: If your order does not arrive within the expected timeframe, contact us and we will investigate and resolve the issue

8. Intellectual Property

8.1 Our Content

The SpicySnaps name, logo, website design, and all original content are owned by us and protected by copyright and trademark laws. You may not copy, modify, or distribute our intellectual property without written permission.

8.2 Creator Content

Content uploaded by creators remains the property of the respective creators. Creators grant us a license to reproduce and sell their content as prints. For full details, see our Creator Agreement.

8.3 Your Purchases

When you purchase a print, you receive a physical product for personal use. This does not grant you any rights to reproduce, distribute, or commercially use the image.

9. Content Guidelines

All content on SpicySnaps must comply with our Content Policy. This policy outlines what types of content are permitted on our platform and what is strictly prohibited.

We reserve the right to remove any content that violates our policies and to suspend or terminate accounts of repeat offenders.

10. Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information. By using our Services, you consent to our collection and use of your information as described in the Privacy Policy.

11. Disclaimers & Limitation of Liability

11.1 Service Availability

Our Services are provided "as is" and "as available." We do not guarantee that our Services will be uninterrupted, secure, or error-free. We may modify, suspend, or discontinue any aspect of our Services at any time.

11.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPICYSNAPS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE.

Our total liability to you for any claims arising from your use of our Services shall not exceed the amount you paid to us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless SpicySnaps, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of our Services, your violation of these Terms, or your violation of any rights of a third party.

13. Termination

We may terminate or suspend your account and access to our Services at any time, without prior notice, for conduct that we believe:

• Violates these Terms or any applicable laws
• Is harmful to other users, third parties, or our business interests
• Involves fraudulent or illegal activity

You may terminate your account at any time by contacting us. Upon termination, your right to use our Services will immediately cease.

14. Dispute Resolution

If you have a dispute with us, we encourage you to first contact us at support@spicysnaps.com to attempt to resolve the issue informally.

Any dispute that cannot be resolved informally shall be resolved through binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting a notice on our website or sending you an email. Your continued use of our Services after such changes constitutes your acceptance of the updated Terms.
